A client approached us because he considered his property was threatened by the establishment of a water park on land adjoining a stream next to his property. All good plans�The plan was to dig out adjoining land on the other side of the stream and use that to provide a bank along the water-course to prevent higher water levels invading the stream and so lead to the stream overflowing and entering our clients property. However there was historical evidence of low lying land in the whole area being subject to flooding anyway. There was photographic evidence of our clients property being threatened by the build up of water on surrounding land. What he was concerned about was the fact that banks built on adjacent land would create a “dam” affect on rising waters surrounding his property and from the stream. Then came the problem. He contacted us but only within 24 hours of the planning application being considered by the area planning committee. Had he contacted us far earlier we could have mounted a very strong case against the development based on historic flood levels and the question of the whole eco-structure being severely affected by the introduction of a water park in the area.
